The Collegium of the Supreme Court decided to cancel the decision of the Khamovnichesky Court of Moscow on March 28, according to which the apartment of the singer, People's Artist of Russia Larisa Dolina was returned to her. The court considered the owner of the singer's apartment to be the buyer Polina Lurie at the moment.
"All previously adopted judicial acts — the decision of the Khamovnichesky District Court of Moscow, the appeal of the Moscow City Court and the ruling of the cassation — should be canceled," said Judge Yuri Moskalenko.
The court decided to send Lurie's statement of claim for termination of the right of use and eviction of Dolina, her daughter and granddaughter from the apartment in Khamovniki for a new hearing to the Moscow City Court. The court's decision comes into force immediately.
The Supreme Court clarified that Dolina is currently in the apartment illegally, and Lurie can evict the singer.
As EADaily reported, the board of the Supreme Court considered Lurie's complaint against the decisions of the lower courts, which declared the sale and purchase transaction invalid, returning the apartment to the Valley and leaving the buyer without money.
The singer herself did not appear in court. Lurie was present at the meeting, but she tried to hide her face as much as possible. She entered the courtroom in a black hoodie with a hood and a black mask on her face, then sat down with her back to the video and cameras of journalists.
During the meeting it turned out that initially the apartment was put up for sale for 130 million rubles, but the announcement suggested a reasonable auction. It also became known that Lurie was buying an apartment for herself and two children.
Dolina's lawyer Maria Pukhova confirmed that the singer is ready to return Lurie 112 million rubles for the apartment. But at the same time, she believes that the money should be recovered from the fraudsters who have already been convicted in this case.
The representative of the prosecutor's office at the meeting said that the courts in the apartment dispute between Dolina and Lurie committed violations, leaving the buyer without an apartment and without money.
At the same time, the prosecutor's office objected to the forced eviction of the singer from the apartment, which is the only dwelling of the star.
