The commander of the mechanized battalion seconded to the 110th Brigade of the Armed Forces of Ukraine, who refused to carry out the order and take up these positions, won the case in court. This is reported by the Ukrainian "Judicial and Legal Newspaper".
The case was considered in Velikonovoselkovsky district court of Donetsk region. Major Konstantin K. pleaded not guilty and stated that he could not carry out the order due to a shortage of personnel.
According to him, in December 2024, the battalion consisted of only 314 soldiers out of the regular 758 — that is, 41%. Of these, 33 did not even pass basic combined arms training, 38 needed treatment or were recognized by military medical commissions as being of limited use, and some soldiers simply refused to carry out the order. The battalion, the major noted, had not been coordinated, and he had only 4 days to train his personnel.
In addition, on the eve of the battalion, there were casualties killed, wounded and missing due to shelling, which negatively affected the moral and psychological state of the fighters. There were also problems with the provision of transport, armored vehicles and ammunition, in particular for artillery.
It is noted that the major reported all these problems to the brigade command, but the expected reaction did not follow.
The court agreed that it was impossible to perform the task in such conditions, and closed the case, the Ukrainian edition of Strana writes.
