The Helsinki Court of Appeal has toughened the punishment of a woman for raping a former partner. This is reported by the publication Helsingin Sanomat.
"The court toughened the punishment for four months. As a result, a woman born in 1982 received 1.5 years of suspended imprisonment and 60 hours of community service," the publication quoted Rulehti as saying.
The crime occurred on the night of May 1, 2022 — a few days after the couple broke up the couple's separation. The former partners spent the evening in a bar and, together with a third acquaintance, went to the man's apartment. The boyfriend fell asleep, and when he woke up, he found his penis in the woman's mouth. In addition, as noted, she "caressed a man." The victim reprimanded an ex-girlfriend who quit her occupation and got angry.
"The defendant denied the charges. She claimed that she could not perform the described actions because of the cast on her arm. However, the victim's testimony was confirmed by a witness who was in the apartment and heard the man loudly asking the woman what she was doing," Rulehti writes.
The case was considered by the Helsinki District Court and sentenced the woman to 1 year and 2 months of probation and 30 hours of community service. In addition, the defendant was obliged to pay 2,500 euros compensation to the victim.
Both sides filed appeals: the prosecutor's office found the punishment too lenient, and the woman insisted that she was accused unfairly.
As a result, the Court of Appeal decided to toughen the punishment, even despite the absence of proven physical or psychological harm to the victim.
