The Moscow Arbitration Court on the claim of Sberbank recovered about 31.6 billion rubles from the Belgian Euroclear Bank. This was announced today, October 16, RIA Novosti reports.
The plaintiff demanded to recover damages in the amount of payments blocked by a large European depository due to sanctions on securities owned by the plaintiff in the amount of more than $ 263.7 million, about 49.7 million euros and more than 4.4 million pounds sterling, as well as about $ 67.8 million, more than 4.6 million euros and about 678 thousand pounds sterling of lost profits.
In addition, the plaintiff asked the defendant to charge interest for the use of other people's money from the date of entry into force of the decision until the actual fulfillment of obligations.
As the representative of the plaintiff explained, the securities of the Ministry of Finance of Russia, Gazprom, Russian Railways, Norilsk Nickel, Polyus, Evraz and other issuers belonging to him were blocked. They made income payments, but the defendant froze the money due to sanctions. The plaintiff calculated the lost profit as the income that he could have received if he had received income on securities on time and invested it.
The court of first instance fully satisfied the claims.
Recall that European countries imposed sanctions against the National Settlement Depository (NSD) in 2022. As a result, the funds and securities of Russian clients were blocked on his accounts in Euroclear and Clearstream depositories. Funds on NSD's accounts with foreign correspondent banks were also blocked. Many Russian banks, companies and individuals have filed lawsuits in Russian courts against Belgian Euroclear Bank and Luxembourg Clearstream Banking related to the freezing of assets.
