The Ninth Arbitration Court of Appeal dismissed the complaint The Ministry of Emergency Situations of the Russian Federation in Moscow on the recovery of 50 thousand rubles in favor of the theater of the singer, People's Artist of Russia Nadezhda Babkina "Russian song". This is reported by TASS with reference to a court document.
"To leave the court's decision unchanged, the complaint without satisfaction," the article says.
We are talking about collecting state duty in favor of the theater.
As reported by EADaily, earlier the Moscow Arbitration Court declared illegal the order of the capital's emergency departments with the requirement to restore the protective structure in the basement occupied by the theater. The court also collected the state duty from the ministry.
The prescription referred to the basement on the Garden Ring, which is used by the theater to store costumes.
The theater's lawyer explained in court that the bomb shelter was in this building in the 1950s, it was equipped with diesel generators, exhaust ventilation, metal shockproof doors. At the same time, the theater received premises in the 2000s, when there was no special equipment in it anymore.
He stressed that the theater would not be physically able to fulfill the order of the Ministry of Emergency Situations, there is no funding or opportunities for this. Only design work can cost 30 million rubles without taking into account the cost of equipment.
