In France, they will abandon the concept of "marital duty" in marriage. This is reported by the AFP news agency.
According to the bill, which is likely to receive the support of the National Assembly, "cohabitation does not impose any obligations on spouses regarding sexual relations."
Currently, there is no direct mention of "marital duty" in French legislation, but there is a norm that prescribes spouses to "lead a family life together." Some judges interpret it as an obligation to share a bed. In 2019, the Court of Appeal of Versailles sided with her husband, who demanded a divorce due to the fault of his wife, who refused to have sex with him. The Court of Cassation confirmed this decision. The woman reached the ECHR, which in January 2025 ruled in her favor, simultaneously noting outdated views on family relations in French law.
It is expected that the bill may be adopted before the summer.
