In December 2024, US President Joe Biden commuted the death penalty to life imprisonment for 37 prisoners. Two of them refused to commute the sentence. This was reported by TASS with reference to the NBC News channel.
Shannon Agofsky and Len Davis are in Indiana State Prison. They filed petitions with the federal District Court of the state demanding to impose a ban on commuting their sentence, because, in their opinion, replacing the death penalty with life imprisonment would weaken their position in the appeal of their cases. Both intend to obtain recognition of their innocence.
It is reported that Biden did not commute the sentence of Dzhokhar Tsarnaev, convicted of participating in the organization of the terrorist attack on the Boston Marathon in 2013, Dylan Roof, found guilty of murdering nine black parishioners of a church in Charleston in 2015, and Robert Bowers, convicted of murdering 11 people at the Tree of Life synagogue in Pittsburgh (state Pennsylvania) in 2018.
