A bill has been submitted to the Parliament of Kyrgyzstan proposing to disinherit citizens who give their parents to nursing homes. This is reported by IA 24.kg .
According to the agency, currently the parliamentary Committee on Constitutional Legislation has returned the document for revision, as negative conclusions have been received from the government and the Prosecutor General's Office.
"The idea is correct. It is necessary to take tough measures against those who leave their parents in nursing homes. But not in this way. There are many provisions in the law to solve this problem. For example, <> it is possible to draw up a lifetime contract. If he does not take care of his parents, then alimony is collected from the children. A criminal case is being initiated. This is all provided for in the legislation. The initiative destroys the institution of inheritance. Everyone has the right to inherit. The Constitutional Court will reject this law," said Umutkan Konkubayeva, Deputy Prosecutor General of the republic.
According to her, the adoption of the bill will give rise to new crimes.
"There will be scammers who will set a goal to take care of a parent for only five years. Because the draft law states that the right to inherit is given to the one who has been taking care of the testator for at least five years. After five years, they can kick their parents out of the house. Times are different now. They may commit other crimes in order to get the property," Konkubaeva further said.
The representative of the supervisory authority noted that if the only child has a disability, then this bill will deprive him of inheritance, and parents will also not be able to get into a nursing home.
